BetMGM and the complainant's defense will have 15 minutes to discuss important aspects of the case at the next hearing. Within the allotted time, the defense of each side will have the chance to hear a statement from one or more lawyers. By proving either an out-of-pocket loss or a denial of the benefit of one's bargain, the oral arguments are supposed to reveal whether the victim adequately pleaded an ascertainable loss. The parties will simultaneously hear each side's perspective on whether or not "a misstatement or deceit" is necessary for claims under the New Jersey Consumer Fraud Act.
